These Terms of Service ("Terms") are a binding agreement between you ("you", "your", "Certifier") and Compliance Hub ("we", "our"). By creating an account or using the Compliance Hub web application (the "Service"), you agree to these Terms.
1. Who can use the Service
The Service is designed for accredited swimming pool certifiers, building surveyors, and their teams operating in New South Wales, Australia. You confirm that:
- You are 18 or older and can enter into a legally binding contract in Australia.
- Where the Service is used to issue Certificates of Compliance or Non-Compliance under the Swimming Pools Act 1992 (NSW), you personally hold a current accreditation as a Registered Certifier or hold delegated council authority.
- You will use the Service in accordance with all applicable NSW and Commonwealth laws, including the Building Professionals Act 2005 and the Design and Building Practitioners Act 2020.
2. Your account
You are responsible for keeping your password confidential and for all activity under your account. Notify us immediately at pascertification@gmail.com if you suspect unauthorised access.
3. Court-grade audit logs
The Service records an immutable audit log of every material change to an inspection record — including edits to AI reports, finalisation events, lock/unlock actions, and any deletions. These logs are retained for at least seven (7) years and may be produced in response to a lawful court order or Land and Environment Court proceeding. By using the Service, you consent to this retention.
4. Subscriptions and payments
- Paid tiers are billed in Australian Dollars via Stripe. Prices exclude GST unless stated.
- New accounts receive a free 14-day Pro trial. If you do not upgrade before the trial ends, your account automatically drops to the Free tier — no card is captured during trial signup.
- Paid subscriptions extend your tier by 30 or 365 days per checkout. There is no automatic recurring charge — you re-purchase when the term ends.
- Refunds within 14 days of purchase are available for unused subscription periods where no AI reports have been generated. Contact pascertification@gmail.com.
5. Content you upload
You retain all rights to the photos, notes, inspection data, and knowledge base entries you upload ("Your Content"). You grant us a limited licence to store, process, and display Your Content solely to operate the Service on your behalf. We do not use Your Content to train third-party AI models.
6. AI-generated reports
The Service generates compliance report drafts using large language models (currently Anthropic's Claude Sonnet 4.5). AI drafts are a starting point, not a substitute for professional judgment. You must review and, where appropriate, edit every AI-generated report before finalising or providing it to a homeowner. You bear sole professional responsibility for every certificate you issue.
7. Acceptable use
You must not use the Service to:
- Issue certificates for pools you have not personally inspected.
- Impersonate another certifier or upload their signature without written consent.
- Attempt to reverse-engineer, scrape, or resell the Service.
- Store data that is not related to swimming pool compliance work.
8. Team accounts
Where you invite team members under a Pro or Enterprise plan, you as the account owner are responsible for their conduct under these Terms. Removing a team member does not delete their historical inspection records; those remain visible to the removed user under their own account.
9. Termination
We may suspend or terminate your account if you materially breach these Terms, if payment fails, or if we are required to by law. On termination we will retain your data for 30 days to allow export, then delete it — except inspection records (retained for at least 10 years to satisfy statutory record-keeping requirements), audit logs, and payment records retained under Australian tax and evidence law.
10. Limitation of liability
To the maximum extent permitted by law, our aggregate liability to you for any claim arising out of the Service is limited to the fees you paid us in the 12 months preceding the claim. Nothing in these Terms limits any consumer guarantee under the Australian Consumer Law.
11. Governing law
These Terms are governed by the laws of New South Wales, Australia. Any dispute will be resolved in the courts of NSW.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be emailed to your account address at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
